These Terms of Service govern your use of the OutPulse platform, including the web application, API, Chrome extension, and all related services. By creating an account or using OutPulse, you agree to these terms.
By accessing or using OutPulse, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using OutPulse on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree to these terms, do not use OutPulse.
OutPulse provides B2B email intelligence services including: email verification (SMTP-level), email finding, lead management, outreach sequences, deliverability scoring, and related tools.
OutPulse is designed for legitimate B2B sales and marketing purposes only.
You are responsible for maintaining the security of your account credentials and API keys.
You are responsible for all activity that occurs under your account.
You must provide accurate and complete registration information.
You must be at least 18 years old to use OutPulse.
You MUST NOT use OutPulse to: send unsolicited bulk email (spam), harvest email addresses for spamming purposes, send emails with deceptive headers or subject lines, send emails without a valid physical postal address, send emails without a functioning unsubscribe mechanism, or violate any applicable anti-spam law.
You MUST comply with all applicable email laws in your jurisdiction and the recipient's jurisdiction, including but not limited to: CAN-SPAM (US), CASL (Canada), GDPR (EU), PECR (UK), Spam Act 2003 (Australia), PDPA (Singapore), and LGPD (Brazil).
You are solely responsible for obtaining any required consent before sending commercial emails through OutPulse's sequence feature.
OutPulse reserves the right to suspend or terminate accounts that violate this policy without notice.
Every email sent through OutPulse sequences MUST include: a valid physical sender address, a one-click unsubscribe link (automatically included by OutPulse), honest From name and subject line.
You must honour unsubscribe requests within 10 days. OutPulse automatically suppresses unsubscribed contacts.
You must not send to purchased lists without verification of consent.
Canadian recipients (CASL): You must have express consent or an existing business relationship before sending commercial messages.
EU/UK recipients (GDPR/PECR): You must have a lawful basis (legitimate interest for B2B or consent) before sending.
OutPulse operates on a credit-based system. Credits are consumed when you use verification, finder, or other metered services.
Unused credits expire at the end of each billing cycle and do not roll over unless specified in your plan.
Refunds are available within 14 days of purchase if fewer than 10% of credits have been consumed.
We reserve the right to change pricing with 30 days notice to existing customers.
API access is subject to rate limits as documented in our API documentation.
API keys are confidential. You must not share, publish, or embed API keys in client-side code.
Automated scraping of OutPulse's web interface is prohibited. Use the API instead.
You retain ownership of all data you upload to OutPulse (leads, contact lists, sequence content).
OutPulse retains ownership of verification results, confidence scores, and platform-generated metadata.
You grant OutPulse a limited license to process your data solely for the purpose of providing the service.
OutPulse and its logos, designs, and content are the intellectual property of OutPulse Technologies.
You may not copy, modify, distribute, or reverse-engineer any part of the OutPulse platform.
OutPulse provides email verification and finding on a best-effort basis. We do not guarantee 100% accuracy of verification results or email discovery.
OutPulse is not liable for: emails that bounce despite "valid" verification status, business losses resulting from inaccurate data, third-party service outages affecting our platform, or actions taken by users that violate applicable laws.
Our total liability is limited to the amount you paid to OutPulse in the 12 months preceding the claim.
You may terminate your account at any time through account settings or by contacting support.
We may suspend or terminate accounts that violate these terms, engage in abusive behavior, or fail to pay outstanding invoices.
Upon termination, your data will be retained for 30 days (for recovery purposes) and then permanently deleted. You may request immediate deletion via our GDPR data deletion feature.
You agree to indemnify OutPulse against any claims, damages, or expenses arising from: your violation of these terms, your violation of any applicable law, your use of the outreach/sequence feature in a manner that violates anti-spam laws, or any third-party claims related to data you process through OutPulse.
These terms are governed by the laws of India. Disputes shall be resolved through arbitration in [City], India, under the Arbitration and Conciliation Act, 1996.
For EU/EEA users: Nothing in these terms affects your statutory rights under GDPR or local consumer protection laws.
We may update these terms with 30 days notice for material changes. Continued use after the notice period constitutes acceptance.
Non-material changes (typo fixes, clarifications) may be made without notice.
